Monaco GP Yacht Tickets

GENERAL TERMS AND CONDITIONS OF SALE

This Contract sets out the terms and conditions under which Monaco GP Yacht Tickets provides the tickets and services to the Client for the Monaco Grand Prix (herewith the “Event”). It also determines the responsibilities and the contractual relationship between Monaco GP Yacht Tickets and the Client resulting from a purchase of a seat for the yacht moored at Port Hercule Monaco for the Event.

Monaco GP Yacht Tickets (herewith the “Seller”) is a trading name for a project organized by MP Yachts and Pekka Vehkonen, and the Client means any person who purchases their ticket for the boat and the services offered by the Seller directly or through an intermediary (third person, agency, company staff committee, etc.)

1. Bookings

• Bookings will be confirmed by the Seller only upon receipt of a full payment and this document duly completed, dated and signed by the Client or by the intermediary (business stamp mandatory for companies or any entity other than a private individual).
• The Seller reserves the right to refuse any incomplete or unacceptable bookings.
• The booking will become effective when a confirmation of the booking has been sent to the Client.

2. Ticket delivery

• If ordered 3 weeks before the start of the Event or earlier: All tickets will be sent by registered post to the address indicated by the Client approximately 3-4 weeks before the Event. In some cases, the tickets can be delivered in-person.
• If ordered within 3 weeks before the start of the Event: All tickets will need to be picked up in-person, normally in Monaco before or during the Event. The seller’s staff will bring the ticket(s) to the agreed meeting point, normally the entrance of the GP, or the ticket(s) can be picked up from an agreed pick-up point.
• Once the ticket(s) is received by the Client, the Seller is not obliged to re-issue or compensate any damaged, lost or stolen tickets / passes issued by the Automobile Club of Monaco or the Seller, which might render access to the circuit and the yacht impossible. Possible duplicates cost 250€.

3. Cancellations

• No cancellations may be made by the Client after the booking is confirmed. However, the Seller may help the Client to re-sell his / her ticket but without warranty of the sale.

4. Liabilities

• Should a major and unforeseeable occurrence prevent the vessel from getting to the port and/or being there for the Event (serious fire or engine failure before the Event, collision at sea giving rise to a serious hull breach immobilising the boat, sale etc.), the Seller shall not be held responsible for damages or loss and compensation in the case the service is cancelled because of that kind of reasons outside its control. However, the Seller undertakes to reimburse payments made by clients as soon as possible.
• In the event of force majeure, as defined by law, including war, riots, government act or regulation, strikes, lockouts, cyber or hostile network attack, inability to secure transport etc., the Seller shall not be liable for any failure to perform or delay in performance and no money will be refunded to the Client.
• The Seller or its agents and staff shall not be liable for any injury, damage or loss including consequential loss to any person or their possessions, including personal injury, disease or death from any cause whatsoever. The Client hereby indemnifies and holds the Seller and its agents harmless against any and all claims in respect of personal injury or damages either direct or consequential arising from any cause whatsoever as a result of the participation by the Client and persons under his authority in the Event. The Client also agree, accepts and acknowledge that motor racing, the Event and certain activities associated therewith are dangerous and accidents can happen.
• In case of any changes to the dates and/or times of the Event, or the cancellation of the Event for any reason whatsoever, the Seller may not be held liable.
• For several years, the yacht has had a berth for the Event near the Quay Chicane with a view of the bend Chicane. Yet, this position may change when berths are officially designated some days prior to the Event resulting from the final decisions of harbour authorities, race organizers etc. The Seller shall not be held liable in such cases.
• The Client is responsible for any damages caused to the yacht by his or her behaviour.
• The Client is responsible for having a travel and civil liability insurance.

5. Children & Age limit

• Children under 12 years of age (on the day of the Event) shall not be allowed on board for the safety and comfort reasons except where a dispensation is granted by the Seller. Any minor children on board shall be under the supervision and responsibility of their parent(s) of those accompanying the children all the time during the Event.

6. Alcohol consumption

• Since alcoholic beverages are served on board in addition to non-alcoholic beverages, the Client undertakes to consume alcohol in moderation and remains solely responsible for his or her behaviour and any consequences of alcohol consumption (falls on board, on water taxis, break something, etc.).
• The Seller’s staff and the crew of the yacht have the right to refuse to continue to serve any client that they believe is showing signs of intoxication.
• Alcohol consumption by minors is strictly forbidden.

7. Photo release

• The Seller’s staff may take photos or videos during the Event for marketing purposes. If the Client does not want to appear by chance in any marketing materials that may be reproduced on any type of media, he or she is kindly asked to inform the Seller’s staff.

8. General

• The Client shall comply with the laws and regulations of Monaco.
• Polite and courteous behaviour is required on board respecting fellow passengers, crew members and other staff. Any breach of this obligation will result in removing the Client and/or accompanying persons from the yacht and no refunds may then be granted.
• No pets or other animals are allowed on board.
• Unless otherwise agreed, smoking shall be restricted to the exterior areas of the yacht designated by the Captain.
• The Clients accommodating on board the yacht need to have their identification document, preferably passport, with them. Other Clients also may need to show an identification document during the Event at the checkpoints or by the crew or staff of the yacht in order to board the vessel, and they confirm to be able to comply with any request in this regard
• Intermediaries purchasing one or more tickets on behalf of one or more persons to whom they then pass on the ticket(s) confirm that they have been made aware also all these persons of these General Terms and Conditions of Sale and they accept them unconditionally. They undertake to bring these terms and conditions to the attention of the person(s) that will make use of the ticket(s) and who is (are) de facto bound by this commitment.

9. Governing law

• This document, and any dispute or claim arising out of or in connection with, shall be governed by and constructed in accordance with Finnish law, excluding any other. In the event of a dispute, the parties shall enter into negotiations with a view to amicable resolution. If no solution can be found, the dispute shall then be referred to the competent courts of Finland.

The Client acknowledges to have read these General Terms and Conditions of Sale and accepts them unconditionally.
